Questions from Poland

Poland has strict GDPR enforcement. How does Wisemonk handle the transfer of employee data to India?
India is not on the EU's adequacy list, so a raw data transfer would breach GDPR. We address this with a full cross-border data transfer package: a Data Processing Agreement, Standard Contractual Clauses under Article 46(2)(c), and a Transfer Impact Assessment template your DPO can sign off on. Your employee data sits in our systems under contractual protections that satisfy Polish supervisory authority (UODO) requirements.
Our Polish employment contracts include specific notice periods and severance norms. Does the Indian hire get something comparable?
Indian employment law is different that include notice periods, gratuity, and termination norms are governed by the Shops and Establishments Act and central labour codes, not by Polish standards. What we do is structure the Indian employment contract to meet all local statutory requirements while aligning on the spirit of your internal HR policies where possible: probation length, leave entitlements, variable pay structure. The Indian employee gets a compliant local contract; you get consistency with your global HR framework.
We invoice in PLN internally. Can we pay Wisemonk in złoty, or does this have to be in a hard currency?
You can invoice us in PLN. We handle the FX conversion on our end and run the Indian payroll in INR. There's no requirement for you to open a foreign currency account or route payments through a hard currency.
What happens if we want to convert the EOR hire to a direct employee once we set up our own Indian entity?
It's a clean handover. When you're ready to incorporate in India and take the employee onto your own payroll, we manage the transition: we close out the EOR employment compliantly (full and final settlement, gratuity calculation, PF transfer), and the employee joins your entity without a break in service where the law allows it.
