PEO vs EOR. What is the difference?
A PEO is a co-employer. It shares the responsibilities of employing your team, handling HR, payroll, benefits and compliance, while you direct the work. An EOR is the sole legal employer. In the Indian market the two terms are often used for the same outsourced-employment service, and Wisemonk delivers both.
Who employs my India team, and who manages them?
Wisemonk carries the statutory and administrative employer responsibilities in India, so you do not need your own entity. You direct the work, set priorities, run performance, and decide who joins and who leaves. We share the employer load, we do not take over your team.
How are taxes, PF and statutory contributions handled?
We deduct TDS at source, contribute to Provident Fund and ESIC on schedule, pay professional tax in the relevant state, and accrue gratuity per the Payment of Gratuity Act. You get a monthly compliance report with every challan, filing and acknowledgement.
What benefits do employees actually get?
Group health insurance (₹5L base, upgradable), term life and personal accident cover, mental wellness sessions, leave per the local Shops & Establishments Act, equipment leasing, and optional learning and development stipend. You can layer extras like ESOPs, education support or fertility benefits.
Is my intellectual property protected?
Yes. Every contract Wisemonk draws includes IP assignment to your company, non-disclosure, non-solicit and non-compete clauses tuned to be enforceable under Indian law.
Can I move my team to my own Indian entity later?
Yes. Many companies start on our PEO and set up their own entity once the India team reaches a certain size. When you are ready, we transfer employment, preserve tenure, benefits and statutory history, and hand over clean records. There is no lock-in and no exit fee.
