Questions from USA

Do my Indian employees owe US taxes?
No. They are employees of Wisemonk India Pvt. Ltd., resident in India for tax purposes. They pay Indian income tax. The DTAA between the US and India eliminates double taxation, and we file Form 10F and TRC each year so your AP team can rely on standard W-8BEN-E withholding.
Can I issue stock options to employees on Wisemonk's payroll?
Yes. We support ISO and RSU grants under your existing US plan. We handle the FEMA Liberalised Remittance Scheme reporting, the perquisite valuation at exercise, and the TDS withholding so your Carta or Pulley records line up with Indian payroll.
What happens if I want to spin up my own entity later?
We have done it 40+ times. You give us 60 days notice, we transfer the employment to your entity with continuity of service preserved, transfer PF accounts, and your Indian CA takes over from there. No team disruption.
Who owns the IP that my Indian employee creates?
Your company does. The employment contract assigns all work-product IP to your US entity (or a designated affiliate) at the moment of creation, with India-law and US-law parallel assignments. The Wisemonk-employee relationship is purely the employment vehicle; the working relationship and IP flow stay with you.
