Questions from Germany

If GDPR treats India as a third country, is the data transfer safe?
Yes. India is a third country under GDPR Article 44, but we operate under the modernised 2021 EU Standard Contractual Clauses with a Transfer Impact Assessment that the EDPB framework accepts.
Does AÜG (German temporary employment law) apply?
AÜG does not apply because your Indian engineer is employed in India by Wisemonk and works on Wisemonk's own service mandate. They are not seconded to your German entity and do not work in German workplaces. If a future trip to Germany is needed, we structure it as a business trip, not as labour leasing.
How is payroll handled?
We run compliant INR payroll, file all statutory contributions (PF, ESI, TDS), and bill you a single line in your local currency.
How do probation and termination work in India?
Indian probation is typically 3-6 months. Notice periods are 30-90 days depending on seniority and the role. We embed your preferred terms in the contract. Wisemonk handles the termination process under the Indian Industrial Disputes Act, including final settlement, gratuity, and the F&F letter, so the employee leaves cleanly and your records stay clean.
