Can you legally run a service desk around the clock from India?
Yes. There is no cap on how long an establishment may stay open. The caps apply to how long any individual may work, so round-the-clock operation is a rostering question, not a prohibition.
Two things have to line up. Your establishment needs permission to operate round the clock under the applicable state law, and each person's hours have to stay inside the statutory ceiling.
The first is usually straightforward and often already granted. Tamil Nadu permits all shops and establishments employing 10 or more people to operate on all days of the year, under a notification effective from 5 June 2025 for three years.
That renewable structure matters. In several states, round-the-clock permission is a periodically renewed exemption rather than a permanent right, so it belongs on a compliance calendar. The second condition is where the real design work sits.
What do India's working-hour rules allow per person?
Each worker is capped at 8 hours a day and 48 hours a week. Beyond that is overtime, payable at twice the ordinary wage rate and capped at 144 hours per quarter under the OSH (Central) Rules notified on 8 May 2026.
Two details matter more than the headline numbers. Overtime is computed daily or weekly, whichever favours the worker, so you cannot average a heavy week against a light one. Spread-over is capped at 12 hours.

The quarterly cap is the line most desks hit first. It works out to roughly 11 extra hours per person per month, which an under-staffed rota consumes inside one busy quarter, leaving no legal headroom for a genuine incident. Which law binds your desk, the OSH Code or your state's Shops Act?
For most service desks, your state's Shops and Establishments Act. This is the most common mistake in published guidance on the topic, and it changes which conditions you actually have to meet.
All four labour codes came into force on 21 November 2025, and the OSH Central Rules followed in May 2026. But those Central Rules bind central-sphere establishments.
Most states have not yet notified their own OSH rules. So for state-sphere establishments, which is what a commercial desk in Bengaluru, Pune or Hyderabad almost always is, the existing state Shops Act and its notifications still govern. The wider labour laws in India map how the codes sit against what employers must change operationally.
There is a second misdirection worth naming. Much of the advice circulating on night shifts cites the Factories Act, 1948. A service desk is not a factory.
Read the Code for the floor and the direction of travel, then read your state's notification for the conditions you have to satisfy. Where the two differ, the stricter one is the safe design point.
What are the night shift rules for women on your roster?
Section 43 of the OSH Code entitles women to work in all establishments and all shifts, including before 6am and beyond 7pm, with their consent. That removed a longstanding patchwork of prohibitions.
It also attached conditions, and states have layered stricter ones on top. The recurring obligations are written consent, employer-provided door-to-door transport at no cost, and prescribed safety measures.
Several states now specify GPS tracking on transport, police-verified drivers, CCTV, rest and locker facilities, and rotation rather than permanent night assignment. The differences are material:

The Telangana minimum of five women per shift is the condition that most often invalidates an otherwise sensible rota. A desk planning two agents per night cannot roster a single woman onto nights in Hyderabad.
She needs four female colleagues on the same shift, or the shift is non-compliant. Maharashtra takes a different route, with section 13 setting the window at 9:30pm to 7am and requiring transport to the doorstep. Either way, the constraint belongs in your headcount model before you sign a lease.
Expert Tip: Build your night roster from the strictest constraint in your state, then work backwards to headcount, never the reverse. Teams that size first and read the notification later end up either over-hiring to reach a group minimum or running a roster that surfaces at the first audit.
Consent is not a one-time formality either. It is revocable, several states require a prescribed form, and it must be on file for each woman on nights, which makes it an ongoing payroll and records obligation rather than an onboarding checkbox.
Do you have to pay a night shift allowance in India?
No central statute prescribes a night shift premium. The widely repeated claim that the Factories Act mandates one does not survive a reading of the Act: section 57 only explains how a past-midnight shift counts toward the weekly holiday.
That does not make the allowance optional in practice. India's support market prices night work, and a desk that does not pay for it will lose staff to one that does.
What it means is that you set the number as a compensation decision, benchmarked against the market rather than copied from a statute. Prevailing practice falls into two structures:
- Percentage of basic: 10 to 15% across industries generally, rising to 15 to 25% in IT and support where overnight customer-facing work is the norm.
- Flat per shift: commonly 100 to 500 rupees a shift, with higher figures for senior or voice-facing roles. Either way, the allowance is fully taxable for the employee.
The structure you pick has a long tail. A percentage of basic grows automatically as salaries rise, particularly once basic sits at half of total pay under the standardised wage definition, so check how your salary structure is built. A flat per-shift amount gives a more predictable cost line as the desk scales.
How many people do you actually need to cover 24/7?
More than you think, and more than the figure quoted almost everywhere else. The number usually cited is 4.2 people per seat, but that is 168 hours divided by a 40-hour week, which is a US assumption rather than an Indian one.
India's statutory week is 48 hours, so the raw ratio depends entirely on the roster you choose. Shrinkage for leave, weekly offs, training, sick days and attrition gaps then applies on top, typically 20 to 30%.

The six-day column is a statutory possibility, not a recommendation. To convert this into headcount, multiply by how many people you need live at once: two agents on a five-day nine-hour roster needs about ten people, three agents about fifteen.

Confirm the figure in your state's notification and design your rota to 12. That single choice removes the most common breach, the quick swap from a night shift onto an evening shift the next day.

Which Indian city should you run the desk from?
Not automatically Bengaluru. For a shift operation, retention matters more than the salary differential, and Bengaluru is where retention is hardest.
National attrition ran 16.2% in 2025 and is projected near 16.5%, but voice-led support runs 30 to 35%. Within capability centres, voluntary attrition is 14.3% in Bengaluru against 8.2% in Chennai, and Tier-II cities run 10 to 15% lower for comparable roles.
That spread is decisive at nearly five FTE per seat. Every point of attrition multiplies across the whole roster, and a frontline replacement costs around 40% of annual pay before you count ramp time.

Hyderabad carries one caution given the earlier point: Telangana's five-women minimum applies there, so a small night roster is harder to staff compliantly than the talent data alone suggests. How quickly people raise problems also depends on the hierarchy and unwritten rules they are used to.
Which operating model fits: build, EOR, staffing or managed services?
There are four ways to put a 24/7 desk in India, and they differ mainly in who employs the people and who owns delivery.
Build an in-house team

Outsource the work

What breaks first as the desk scales from 5 to 30 agents?
The failure sequence is consistent, and it is not where most plans expect. Knowing the order lets you hire ahead of each break rather than after it.
Phase 1, five to ten agents: coverage is fragile, not compliance
One person's leave breaks the rota. Handovers happen in a chat channel and context is lost nightly. There is no shift lead, so the manager is woken for escalations. Fix the escalation path and name a lead per shift before adding headcount, which is the same sequencing an offshore team build needs generally.
Phase 2, ten to twenty agents: records become a daily job

That ladder is the single most effective retention lever in a shift operation. Without it, your best analysts leave at 18 months. As the desk touches more systems, check that you own what the team builds and that your employment agreements carry the confidentiality terms to match.
When does running the desk from India stop making sense?
Three situations, and it is worth being straight about them:
- Volume is genuinely low. If out-of-hours volume is two tickets a night, an on-call rotation with a paid retainer costs a fraction of five FTE per seat. Follow-the-sun earns its cost at volume, not at principle.
- The work needs presence or rare languages. Desk-side support, hardware swaps and regulated in-country data handling do not travel, and English depth does not extend evenly to every European or East Asian language.
- Night volume is small but complexity is high. One L3-grade engineer awake at 3am is expensive and lonely, and one person cannot be a shift. Distributed on-call across senior staff usually beats a thin overnight tier.

- How quickly can it run? Six to ten weeks through an EOR: two to four weeks to hire, two to onboard, a fortnight of shadowing before nights go unsupervised. Your own entity adds three to six months.
- What does it cost annually? About 87 to 90 lakh for an eleven-person desk with two agents live around the clock. Cost per seat falls as you grow, because the lead and quality layer spread across more agents.
- What are the biggest risks? Breaching the quarterly overtime cap while short-staffed, missing state night conditions for women, and breaking the inter-shift rest gap through informal swaps. All three are rota design problems.
- Which work suits it? High-volume triage, access and password work, monitoring, known-error resolution and L2 diagnosis travel well. Hardware handling and regulated in-country data work do not.
