Questions from Japan

Can a Japanese company legally employ Indian workers without setting up an India entity?
Not directly. Indian labor law requires an employer of record registered in India to handle PF, ESIC, gratuity, and TDS obligations. A Japanese KK or GK cannot run an Indian payroll from Tokyo. The two compliant options are either incorporating an Indian subsidiary (typically 4 to 6 months and ongoing compliance overhead) or partnering with an EOR like Wisemonk, where the Indian entity (Wisemonk India Pvt. Ltd.) is the legal employer while the day-to-day work direction remains with your Japan team.
How does the India-Japan DTAA affect EOR arrangements?
The India-Japan Double Taxation Avoidance Agreement, in force since 1989 and updated in 2006, prevents the same income from being taxed in both countries. For an Indian employee on Wisemonk's payroll, taxation happens in India (TDS deducted at source, employee files Indian returns), and your Japanese entity has no Indian tax obligation on that salary. The DTAA also helps on the Permanent Establishment question: a properly structured EOR arrangement keeps the Indian employee from creating PE exposure for your Japan company, which would otherwise trigger Indian corporate tax on a portion of your global income.
Will time zone overlap actually work between Japan and India teams?
Better than most cross-border arrangements. India is 3.5 hours behind Japan (IST is GMT+5:30, JST is GMT+9). A standard Indian workday of 10am to 7pm IST overlaps with 1:30pm to 10:30pm JST, giving you roughly 4.5 hours of natural overlap with Japan afternoon hours.
How do Japanese cultural and communication expectations translate in Indian teams?
This is where most Japan-India arrangements quietly succeed or fail, and it's worth being explicit about. Japanese business culture values consensus building (nemawashi), structured reporting (hou-ren-sou: hokoku, renraku, sodan), and indirect communication. Indian engineering culture, particularly in startups and product companies, runs faster, flatter, and more direct. Neither is wrong, but mismatched expectations create friction.
