Questions from Taiwan

Is the contract governed by Taiwanese or Indian law?
Indian law. Wisemonk India Pvt. Ltd. is the employer; the contract is governed by the Indian Contract Act, 1872, the Industrial Disputes Act, and state-level labour codes. This is cleaner for both sides: your Taiwanese Labor Standards Act does not extend extraterritorially, and the Indian employee gets local protections they understand.
How do we handle data protection for access from India?
Cross-border transfers from India are governed on the Indian side by the DPDP Act, 2023, and on your side by Taiwan's Personal Data Protection Act (PDPA), overseen by the Personal Data Protection Commission. We sign a data processing agreement with appropriate transfer safeguards so your team's access to employee data from Taiwan stays compliant under both regimes.
Can we offer stock options to employees on Wisemonk's payroll?
Yes. We support standard ESOPs from your Taiwanese parent. The trickier piece is the Reserve Bank of India's Liberalised Remittance Scheme reporting at exercise. The employee pays Indian perquisite tax at exercise; capital gains at sale are taxed in India under the 2011 India-Taiwan DTAA.
What about business tax / VAT on Wisemonk's invoices?
Wisemonk invoices from India for services rendered in India, so no Indian GST is charged to you. On the Taiwan side, the import of services is generally subject to Taiwanese business tax (VAT) under a reverse-charge basis, though a business-entity buyer making fully taxable supplies is typically exempt from self-assessing it. We show our Indian GSTIN and your Taiwan unified business number on the invoice; confirm the exact treatment with your local tax advisor.
