Who owns design work you outsource to India?
Not automatically you. Under India's Copyright Act, work created by an employee in the course of employment defaults to the employer, but a commissioned freelancer keeps copyright unless the contract assigns it. Paying an invoice is not an assignment.
That distinction is why design is the function where the paperwork earns its keep. Four things belong in the agreement:
- Written assignment of copyright: express, in writing, covering every deliverable including rejected concepts and working files.
- Moral rights waiver: without it the designer can object to how you later modify the work, which matters for logos that evolve.
- Source files on delivery: layered files and fonts, not just exports. This is the most common practical dispute and the easiest to prevent.
- Stock and font licensing: confirm who licensed what and that the licence covers commercial use at your scale.
