Questions from Netherlands

Does this create a permanent establishment in India for our BV?
No. Wisemonk India Pvt. Ltd. is the legal employer. Your BV has no fixed place of business in India, no dependent agent, no construction site. The PE tests in article 5 of the 1989 NL-India DTAA are not met if you use an EOR.
How does this work with the 30% ruling for employees in India?
The 30% ruling is for foreign employees coming to work in the Netherlands. It does not apply to employees who work in India. If you later relocate one of them to NL, we will provide the prior-employer letter, salary history, and the scarce expertise documentation the Belastingdienst asks for.
Can we issue ESOPs under our NL plan?
Yes, supported. The trickier piece is FEMA Liberalised Remittance Scheme reporting on the Indian side. The employee pays Indian perquisite tax at exercise; capital gains at sale taxed in India under the 1989 DTAA. Box 2 implications stay with your Dutch parent and shareholder.
Can we keep Dutch holidays?
By default Indian employees follow the Indian holiday calendar (typically 12-15 public holidays). Most Dutch clients add King's Day and Liberation Day as floating leave so the team feels in sync with HQ. We code this into the Wisemonk payroll calendar at onboarding.
